TERMS OF USE - CONNECTSTORE

1. ABOUT CONNECTSTORE

ConnectStore is a point-of-sale (POS) system developed by ACSN Desenvolvimento de Software do Brasil Ltda, CNPJ 06.332.765/0001-05, designed to simplify and optimize sales operations. It offers efficiency, flexibility, and control, supporting multiple payment methods and facilitating the management of products and services, providing a fast and secure checkout experience.

2. ACCEPTANCE OF THE TERMS

By creating an account and using ConnectStore, the user agrees and acknowledges that they have read, understood, and fully accepted these Terms of Use. If the user does not agree with any part of the terms, they should not use the application.

3. DEFINITION AND GLOBAL APPLICABILITY

ConnectStore is available for companies and self-employed professionals in different countries and complies with data protection regulations according to the jurisdiction in which the account was created (account location).

By creating an account on ConnectStore, the applicable legislation will be determined based on the country in which the account was registered. This means that:

• Accounts created in Brazil: are subject to the General Data Protection Law (LGPD).
• Accounts created in the European Union: are subject to the General Data Protection Regulation (GDPR).
• Accounts created in the United States: are subject to the CCPA (California Consumer Privacy Act), VCDPA (Virginia Consumer Data Protection Act) and other applicable state laws.
• Other countries: will be subject to the applicable local data protection laws.

If ConnectStore in the future offers additional functionalities, the Privacy Policy and the Terms of Use may be updated to reflect these changes.

4. USER REGISTRATION AND ACCOUNT

ConnectStore is a service intended exclusively for companies, self-employed professionals and their legal representatives. By creating an account, the user declares that they are using ConnectStore for commercial purposes and have the authority to manage their professional activity or represent a company.

If you are not using ConnectStore for commercial purposes or do not have the authority to manage a business, you should not use ConnectStore.

ConnectStore reserves the right to suspend or terminate accounts that violate these Terms of Use. Whenever possible, a notification will be sent to the user prior to suspension, granting a period to correct the violation. In severe cases, the account may be terminated without prior notice.

To access ConnectStore, the user must create an account, providing the required information at the time of registration, which must be accurate and up-to-date.

The user is responsible for maintaining the confidentiality of their access credentials and for all activities performed on their account.

5. PRIVACY AND SECURITY

ConnectStore respects your privacy and protects your personal data in accordance with applicable regulations. Currently, ConnectStore collects and processes data only from companies and self-employed professionals who use the platform for commercial purposes.

ConnectStore collects only the end consumer's email address to send electronic receipts for transactions conducted on the platform. This data is not stored for any other purposes, nor shared with third parties for advertising or any other commercial purpose.

The user may request the deletion of their email at any time, as provided under the LGPD (Brazil), GDPR (European Union) and CCPA (USA). To exercise this right, simply contact via the email dpo@connectstore.app.

The collected emails are securely stored and kept only for as long as necessary to ensure the delivery of the receipt.

If ConnectStore in the future offers additional functionalities involving the processing of more end consumer data, the Terms of Use and the Privacy Policy will be updated to reflect the applicable regulations.

ConnectStore does not sell users' personal data and does not share information with third parties for advertising or commercial purposes. The users' data is used exclusively for providing the platform's services, as described in our Privacy Policy.

6. DATA STORAGE AND RETENTION

The data collected by ConnectStore is stored on secure Microsoft Azure servers, with the geographical location determined based on the account's origin:

• Accounts created in Brazil: Data stored on servers located in Brazil.
• Accounts created in the United States and Spain: Data stored on servers located in the USA.

ConnectStore adopts robust security measures to protect the data, including encryption and access control.

7. CANCELLATION AND REFUND POLICY

ConnectStore does not directly process refunds. All financial transactions conducted on the platform are processed by third-party payment providers. If a payment is made through these integrations, the user must follow the corresponding provider's refund and chargeback policy.

Chargebacks and Fees: If a chargeback is requested, it will be subject to the rules, deadlines, and fees applied by the payment integration provider used in the transaction. ConnectStore does not interfere in this process and is not responsible for any additional charges resulting from chargebacks or financial disputes.

Account Cancellation: Since ConnectStore is a free service, account cancellation does not result in any refund or financial compensation. If there are future changes to the billing policy, users will be notified in advance and will have the option to continue or cancel their account without penalties.

8. PERMITTED AND PROHIBITED USE

Permitted:

• Use ConnectStore for legitimate commercial purposes, in accordance with the functionalities provided on the platform.
• Register your business information, including logo, product images, and descriptions.
• Generate product descriptions with the aid of artificial intelligence (AI).

Prohibited:

• Use ConnectStore for illicit, fraudulent activities, or activities that violate third-party rights.
• Publish offensive, abusive, defamatory, discriminatory, or threatening content.
• Interfere with the functioning of the application, attempt unauthorized access, or distribute malicious code (viruses, malware, spam).

9. USER CONTENT

The user may register information on ConnectStore, including products, services, descriptions, images, and the company's logo.

The user is solely responsible for any content they submit to the platform, ensuring that they have all the necessary legal rights over it. ConnectStore is not responsible for any copyright, trademark, or intellectual property violations of third parties.

ConnectStore reserves the right to remove content that violates these Terms of Use, applicable laws, or is deemed offensive, inappropriate, or fraudulent. User accounts that repeatedly violate these rules may be suspended or terminated.

10. PAYMENTS AND FEES

ConnectStore is completely free to use. However, payments processed through the application may be subject to third-party fees.

Payment processing is carried out by specialized partners, who operate under their own terms and policies. ConnectStore does not store users' banking information and is not responsible for any fees or charges applied by these services.

By using payment functionalities within the application, the user agrees to the terms and conditions of the integrated payment providers.

11. ACCOUNT TERMINATION AND PENALTIES

The user may request account deactivation directly through the application or website, following the indicated procedure. To ensure the security of the request, a confirmation may be sent via email.

Data Anonymization

Upon requesting account deactivation, the user's personal data and business data will be anonymized, becoming irreversible and unidentifiable. ConnectStore retains the anonymized data solely for operational, statistical, and regulatory compliance purposes.

After anonymization, the user will not be able to recover their account or the data associated with it.

Certain financial data may be retained for the period required by applicable tax and regulatory laws.

Data Report Request

Before deactivating your account, the user may request a report containing the data stored about their account. To do so, simply send an email to dpo@connectstore.app. ConnectStore will fulfill the request within the applicable legal timeframe.

ConnectStore may suspend or terminate accounts in cases of:

• Misuse or fraudulent use of the application.
• Violation of the terms of use.
• Judicial order or legal requirement.

12. LIMITATION OF LIABILITY

ConnectStore is provided "as is", without guarantees of uninterrupted or error-free operation. ConnectStore is not liable for technical failures, unavailability, or damages arising from issues with third-party services, including, but not limited to:

• External payment providers (e.g., failures with Stripe or other payment methods);
• Server infrastructure and connectivity (e.g., outages on the App Store or cloud providers);
• Errors in data transmission between integrated systems.

Tax Liability: ConnectStore is not responsible for the fulfillment of users' fiscal, accounting, or regulatory obligations. Each user is responsible for ensuring that their business complies with the laws of their jurisdiction, including invoicing, tax collection, and other local requirements.

13. THIRD-PARTY INTEGRATIONS

ConnectStore may integrate third-party services to offer additional functionalities, such as payment processing, artificial intelligence, and other features.

ConnectStore does not manage nor is it responsible for the operation or policies of these services, and the user is subject to the terms and conditions of the third parties involved when using them.

14. COMMUNICATIONS

ConnectStore may send emails to registered users, including security codes and transaction confirmations.

Consumers may receive payment receipts directly in their emails.

These communications ensure the security and transparency of transactions.

15. INTELLECTUAL PROPERTY

All intellectual property rights related to ConnectStore, including logos, trademarks, texts, images, and software, belong to ACSN.

The user agrees not to copy, modify, distribute, or create derivative works from ConnectStore's content without authorization.

16. USE OF COOKIES

ConnectStore uses cookies and similar technologies exclusively for essential functionalities, ensuring the proper functioning of the application.

17. CHANGES TO THE TERMS OF USE

ConnectStore may update these Terms of Use periodically. Whenever there is a high-impact change that significantly affects the rights or obligations of the user, new explicit consent will be requested before the new rules are applied.

For minor changes that do not alter the fundamental rights of users, notification will be made through the official website, email, and/or within the application. Continued use of the platform after the publication of these changes will be considered acceptance of the new Terms.

The updated versions of the Terms of Use will take effect immediately after their publication, unless stated otherwise. Continued use of ConnectStore after this notification will be considered acceptance of the new terms.

18. GENERAL PROVISIONS

These Terms of Use are governed by and interpreted in accordance with the laws of the country where the user is located, including, but not limited to:

• Brazil: Law No. 13.709/2018 (LGPD).
• Spain/European Union: General Data Protection Regulation (GDPR).
• United States: CCPA, COPPA, VCDPA and other applicable state laws.

Any dispute arising from these Terms will be resolved in the jurisdiction corresponding to the user's domicile or as provided by applicable law.

Should any dispute arise between the user and ConnectStore, the parties will seek to resolve the dispute amicably before resorting to legal action. If no agreement is reached, the case will be resolved in the competent jurisdiction as provided by applicable law.

ConnectStore ensures that no user will be discriminated against for exercising their privacy rights, including access, correction, deletion, or data portability, as provided by LGPD, GDPR, CCPA, and VCDPA.

These Terms constitute the entire agreement between the user and ConnectStore, superseding any previous agreements.

ConnectStore reserves the right to take appropriate measures in the event of a breach of these terms.
